Welcome to Juuhudi. These Terms of Service ("Terms") are a binding agreement between you and Juuhudi Technologies ("we", "us"), the operator of the Juuhudi marketplace at juuhudi.co.ke and related services (the "Service").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Juuhudi is — and what it is not
Juuhudi is an online marketplace that helps people in Kenya buy and sell secondhand items directly with each other.
We facilitate. We do not transact. Juuhudi:
- is not a party to any sale between members;
- does not handle, hold, or transfer payment for items between buyers and sellers;
- does not own, inspect, store, or deliver the items listed;
- does not guarantee that any item will be sold or that any listed item will meet your expectations.
Every transaction is between the buyer and the seller. You are responsible for your own decisions, payments, and meetings.
2. Eligibility
You must be at least 18 years old and capable of entering a binding contract to use the Service. By using the Service you confirm that you meet these requirements.
3. Your account
One person, one account. Each member may hold one account, verified with one phone number. A phone number may be linked to only one Juuhudi account.
You agree to:
- provide accurate information, including your real name and a genuine photo of yourself;
- keep your login credentials secure and not share your account;
- complete profile verification before selling or messaging other members, as required by the Service.
You are responsible for all activity on your account. Tell us immediately at support@juuhudi.co.ke if you believe your account has been compromised.
4. Listing Credits
Juuhudi uses a prepaid system of Listing Credits ("credits") to pay for listing services.
- What credits are: a virtual unit used to pay listing fees, reposting fees, and optional promotional features on the Service. Credits are not money, have no cash value, earn no interest, and cannot be transferred between accounts or exchanged outside the Service.
- Buying credits: credits are purchased in bundles via M-Pesa. The price and contents of bundles are shown at the time of purchase and may change prospectively.
- Credits do not expire.
- No refunds. Credit purchases are final and non-refundable, except where Kenyan law requires otherwise. Credits remaining on an account that is closed — by you or by us — are not redeemable for cash.
- Bonus credits granted by us (including signup bonuses, referral rewards, or promotions) have no purchase value and may be adjusted or withdrawn in cases of fraud or abuse.
- Fees: listing fees depend on the asking price of the item and are shown before you publish. Fees are charged when you submit a listing for review — they pay for the review itself and are not returned if a listing is rejected. Rejected listings may be corrected and resubmitted free of charge up to two (2) times; further submissions require a new fee.
5. Listings and moderation
Every listing is reviewed by Juuhudi before it becomes publicly visible.
- We may approve, reject, or remove any listing at our discretion, including after approval.
- Rejected listings receive feedback explaining what to fix.
- Our review of a listing — photos, description, condition grade, and price plausibility — is a check at a point in time. It is not a guarantee, warranty, inspection, or certification of the item itself, its condition, authenticity, safety, or legality. Buyers must inspect items before paying.
- Listings expire after 30 days. Sellers may renew an unchanged listing free of charge up to two (2) times (a maximum of 90 days of visibility). After that, relisting requires a new fee and a new review.
- You must accurately state an item's condition and a genuine asking price, and mark items as sold promptly once they are no longer available.
6. Prohibited items
You may not list, offer, or sell through the Service:
- weapons, ammunition, or explosives;
- counterfeit or replica goods, or items that infringe intellectual property rights;
- medicines, pharmaceuticals, or medical devices;
- expired, recalled, or unsafe products;
- stolen property or items you do not have the right to sell;
- brand-new commercial goods (Juuhudi is a secondhand marketplace);
- animals, human remains or parts, hazardous materials;
- anything illegal to sell or possess under Kenyan law;
- services, digital goods, or intangible items.
We may update this list at any time. The current list is published in our Trust Centre.
7. Prohibited conduct
You agree not to:
- misrepresent items, prices, or your identity;
- create multiple accounts, or circumvent a suspension or ban;
- use the Service to defraud, harass, threaten, or abuse other members;
- attempt to move members to other platforms to evade our safety measures, or solicit payments through deceptive means;
- post listings for items you do not possess, or use photos that are not of the actual item;
- scrape, harvest, or misuse other members' personal information;
- interfere with the operation or security of the Service;
- use the Service for money laundering or any unlawful purpose.
8. Meeting and transacting safely
Sales are completed in person (or by arrangements the buyer and seller make directly). You agree that:
- you will exercise your own judgement about who to meet, where, and how to pay;
- Juuhudi's safety suggestions (such as recommended public meetup spots) are guidance only, and we are not responsible for what happens at meetings between members;
- inspecting an item before paying is your responsibility as a buyer.
9. Reviews and trust signals
- Ratings and reviews can only be exchanged after a transaction is confirmed by both parties on the Service.
- Reviews must be honest and based on your genuine experience. We may remove reviews that are abusive, fraudulent, or unrelated to the exchange.
- Trust indicators (verification badges, exchange counts, ratings, response information) are generated from activity on the Service. They are informational and are not a guarantee of any member's conduct.
10. Your content
You retain ownership of the content you post (photos, descriptions, profile information, reviews). You grant us a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and promote that content in connection with operating and marketing the Service — for example, showing your listing in search results, link previews, social media channels, or featured collections. You warrant that you own or have the right to use everything you post, and that it does not infringe anyone's rights.
11. Enforcement
We operate a graduated enforcement system: warnings, temporary suspensions, and permanent bans. We may act immediately and without prior warning for serious violations, including fraud, prohibited items, or threats to member safety. Where an account is terminated for violating these Terms, remaining credits are forfeited.
We may also report unlawful conduct to relevant authorities.
12. Account deletion
You may delete your account at any time. On deletion:
- your profile and personal data are erased as described in our Privacy Policy;
- reviews you received remain visible (they belong to the members who wrote them);
- reviews you wrote may remain in anonymised form;
- transaction and credit records are retained as required for legal, accounting, and fraud-prevention purposes.
13. Disputes between members
Disagreements about an item, its price, its condition, or a meeting are between the buyer and the seller. We do not mediate, arbitrate, or refund member-to-member transactions.
We do act on platform violations: report fraud, prohibited items, misrepresentation, or abusive conduct through the in-app reporting tools, and we will review reports within 24 hours.
14. Service availability and changes
We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to give notice of material changes. We do not guarantee uninterrupted or error-free operation.
15. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by Kenyan law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We make no warranty about items listed by members, the conduct of members, or the outcome of any transaction.
16. Limitation of liability
To the maximum extent permitted by law, Juuhudi, its directors, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, goodwill, or data, arising from your use of the Service or any transaction with another member.
Our total aggregate liability for any claim arising out of these Terms or the Service shall not exceed the greater of (a) the total amount you paid to us in the twelve (12) months before the claim arose, or (b) KSh 10,000.
Nothing in these Terms excludes liability that cannot be excluded under Kenyan law.
17. Indemnity
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your listings, your content, your transactions with other members, or your breach of these Terms.
18. Governing law
These Terms are governed by the laws of Kenya. Disputes shall be subject to the jurisdiction of the courts of Kenya.
19. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new effective date and, for material changes, notify you through the Service or by email. Continued use after changes take effect constitutes acceptance.
